The USPTO, Again
This is evidence that the quality of employees at the USPTO continues to degrade. In a recent second Office Action, the Examining Attorney wrote:
The previously issued refusal under Trademark Action Section 2(e)(1) is maintained and continued for the reasons described in the Office action dated January 15, 2009, and as indicated below.
In addition, the following new requirement is made: requirement for further clarification of the significance of the mark.
Really? Is he serious? The mark is merely descriptive for the goods, but I have to clarify the significance of the mark. What the fuck is that? Isn’t the USPTO simply asking my client to concede the descriptiveness of the mark?
It is just stupid. Who hires these people, and what law school do they come from? Seriously.
